Professional Experience

• David leads the insurance practice at Volckrick & Associates. In such position, David assists insurance and reinsurance companies, insurance intermediaries, as well as other financial institutions in all legal, regulatory and contractual matters affecting their insurance business, on a local and cross-border basis.
• He regularly advises insurance companies on M&A and portfolio transfer transactions on both the buy- and sell-side (preparing companies for sale including due diligence investigations on insurance products, contracts and services, preparing the negotiation strategy and developing an integration plan and follow up), and was chiefly involved in several major insurance M&A transactions. David has experience in coordinating international transactions and putting together teams of lawyers to handle transactions covering multiple jurisdictions.
• David is seasoned in the drafting and review of insurance products documentation, distribution agreements (brokerage agreement, agent agreement, referral agreement) as well as standard custodian agreements.
• He regularly helps clients assess the foreseeable impacts of major regulatory changes (insurance law, IDD, PRIIPs, MiFID II/MiFIR, etc.) on their products/ services, distribution model, professional secrecy, inducements, marketing documents, pricing model and operating (and outsourcing) model.
• David has an in-depth knowledge of insurance investment rules (advisory and discretionary asset management mandates) and assets eligibility rules.
• David is in regular contact and has developed a close working relationship with both the Luxembourg Supervisory Authority for the Insurance Sector (Commissariat aux Assurances) and Luxembourg Supervisory Authority for the Financial Sector (Commission de Surveillance du Secteur Financier).
• David is a regular speaker in different insurance conferences and the author of various articles on insurance-related issues contributing to the development of Luxembourg legal doctrine.
• Before working for Volckrick & Associates, David has assumed the positions of Head of Legal at a leading insurance company in Luxembourg and Head of Legal at a global private bank in Luxembourg.
